DISTANCE SELLING AGREEMENT

Article 1: Subject and Scope of the Agreement


This agreement determines the terms and conditions for the sale of products provided by Alpay Group Construction Jewelry and Foreign Trade Inc. via the internet, in accordance with the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation published in the Official Gazette No. 29188. This agreement covers the rights and obligations of both parties regarding the purchase and delivery of products ordered by the buyer from the website www.alpayjewellery.com.

 


Article 2: Product Information


The product purchased by the buyer, including its type, quantity, brand, model, color, sale price, and delivery conditions, is specified in Article 3 of this agreement. All features and images of the product are available on the seller’s website.

 


Article 3: Sale Price and Payment Terms

Shipping costs will be determined based on the product price and will be communicated to the buyer.

 


Article 4: General Provisions


  1. Information and Confirmation: The buyer confirms that they have reviewed and agreed to the product’s main features, sale price, payment terms, delivery time, and seller’s contact information available on the website by confirming the order.
  2. Delivery: The product will be delivered to the buyer’s address within the specified delivery period, after the seller receives the order. The shipping fee will be paid by the buyer.
  3. Seller’s Obligations: The seller is responsible for ensuring that the product is delivered in accordance with the specifications stated in the order, in good condition, and without any defects. If the payment for the product is not made, no delivery will be made.
  4. Payment Terms: The product price must be paid in accordance with the chosen payment method. If payment is not made, the seller will be relieved of the delivery obligation.

 

Article 5: Right of Withdrawal


  1. Withdrawal Period: The buyer has the right to withdraw from the contract within 14 days of receiving the product. The right of withdrawal can be exercised without providing any reason.
  2. Return Conditions: In the event of withdrawal, the buyer must return the product in its original packaging, with its label and invoice, and in undamaged condition within 10 days. Otherwise, the right of withdrawal will be invalid.
  3. Refund Timeframe: If the right of withdrawal is exercised and the product is returned, the seller will process the refund to the buyer within 14 days. For credit card payments, the refund will be processed to the bank, and for payments made via Ininal Card, it will be refunded to the card account within 24 hours.


Article 6: Products for Which the Right of Withdrawal is Not Applicable


The right of withdrawal does not apply to the following products:

  1. Custom-made or specially designed products according to the buyer’s request.
  2. Products with damaged labels or packaging.
  3. Products that cannot be resold due to damage.

 

Article 7: Protection of Personal Data


  1. Data Collection: The buyer will provide the necessary information (name, contact details, payment information, etc.) to the seller for the purpose of this agreement. This data will be processed in accordance with the Personal Data Protection Law No. 6698.
  2. Data Protection: The seller is obligated to process the buyer’s personal data only for the purpose of this agreement and not to share it with third parties. The data will be retained for the duration required by the service and will be deleted in accordance with relevant laws.

 

Article 8: Jurisdiction


In case of any dispute arising from this agreement, the Consumer Arbitration Committees authorized by the Ministry of Customs and Trade, and the Consumer Courts in the seller’s place of residence, will have jurisdiction, provided that the value limit set by the Ministry is not exceeded.

 

Signature and Approval


By completing the order, the buyer acknowledges that they have read, understood, and accepted all the terms and conditions stated in this agreement. The buyer’s confirmation of the order signifies their acceptance of all the provisions of this agreement.
