PERSONAL DATA PROCESSING AND PROTECTION CLARIFICATION TEXT



This Clarification Text is drafted by Alpay Group Construction Jewelry and Foreign Trade Inc. (the "Company") in its capacity as the data controller, in accordance with the Turkish Personal Data Protection Law No. 6698, to inform and clarify the processing of Personal Data belonging to all individuals related to the Company, including customers/users and anyone benefiting from the Company’s products and services. 1. Purposes of Personal Data Processing


Your Personal Data, shared with us in the scope of your legal relationship with the Company, may be processed by the Company in accordance with the provisions of the Personal Data Protection Law and the following purposes. These purposes include but are not limited to:

  • Providing the necessary works for benefiting data subjects from the products and services offered by the Company.
  • Conducting operations with the Company's business partners and/or suppliers.
  • Generating records to facilitate future transactions and automatic invoice preparation.
  • Ensuring that customers benefit from general or personalized campaigns through the created records.
  • Sending information about campaigns, discounts, and new store openings via mail, email, SMS, or phone.
  • Customizing product and service offers based on customers' preferences, habits, and needs.
  • Ensuring customer continuity by offering personalized cards, catalogs, and campaigns.
  • Adjusting purchased products and services to customers’ needs, handling complaints or inquiries, and providing relevant information.
  • Managing marketing, sales, post-sales operations, and customer relationships.
  • Managing human resources, occupational health and safety processes, and complying with legal obligations.
  • Managing administrative, legal, and physical security, as well as financial operations, related to the Company’s locations.
  • Implementing the Company's business strategies, and managing internal system and application operations, communication, and market research activities.
  • Planning and/or executing customer relations management processes, including customer satisfaction activities.
  • Managing visitors' registration and follow-up.

All data processing will comply with the Personal Data Protection Law, especially Articles 5 and 6, under the specified conditions.

 


2. Recipients and Purposes of Personal Data Transfer


Under the conditions set forth in Articles 8 and 9 of the Personal Data Protection Law, the Company may transfer Personal Data to its business partners, stakeholders, Company representatives, or third parties/organizations they designate, to fulfill the following purposes:

  • Executing business operations, services, and activities such as project execution, marketing campaigns, and printing catalogs.
  • Transferring data for legal, operational, or strategic purposes, including the communication of sales campaigns, product modifications, and handling customer complaints.
  • In case of legal requests, Personal Data may be shared with authorized public institutions, private legal entities, or third parties within their legal powers.

If the relevant processing activity does not meet the exceptions set forth in the Law, the Company will obtain your explicit consent for the relevant process.

 


3. Method and Legal Grounds for Collecting Personal Data


Personal Data is collected via various methods such as verbal, written, and electronic means, including call centers, websites, mobile applications, and social media accounts you provide access to. The Company processes this data for the purposes specified in the Law and in compliance with the relevant legislative, contractual, and legal grounds.

 


4. Rights of Personal Data Owners Under the Personal Data Protection Law


Under Article 10 of the Personal Data Protection Law, the Company informs data owners of their rights. These rights include:

  • Learning whether your Personal Data is processed,
  • Requesting information about the processing of your Personal Data,
  • Understanding the purpose of processing and whether your data is used appropriately,
  • Learning the third parties to whom your Personal Data has been transferred,
  • Requesting the correction of incomplete or inaccurate Personal Data,
  • Requesting the deletion or destruction of Personal Data under certain conditions,
  • Requesting that corrections be communicated to third parties to whom Personal Data has been transferred,
  • Objecting to automatic processing of Personal Data resulting in negative outcomes for you,
  • Requesting compensation for damages arising from unlawful processing of Personal Data.
